The Department of Homeland Security (DHS) and USCIS have proposed to modify the regulations of certain employment-based and nonimmigrant visa programs to provide more benefits to the participants. It would support employers looking to sponsor and maintain immigrant and nonimmigrant I-140 beneficiaries. It would assist the I-140 beneficiaries by allowing them to accept promotions, seek other employment options, and become lawful permanent residents of the United States. The purpose of this amendment is to create more stability for employers and workers that are part of the visa programs mentioned above. In this effort, DHS is also attempting to remove regulations that provide a 90-day processing timeline for Employment Authorization Documents. This amendment is still under review. We will provide an update should it come into effect.
